H1b Visa got rejected.   Rajesh Parsad.   03/09/2017 08:22 PM  

With deep sadness I have to inform that my H1B transfer got rejected today. I have 10 days left to go back.
It is going to very hard to change job in near future.

Please pray for me.

Did they you gave you the reason.

you can apply for another company right and i think recently they introduced new law about 60 days.

at this point no company is ready to sponsor the visa.
Have till 3/20 to go back.

it is just matter of time, we all are returning back home.

Go early back grab a good position, by the time we all come back there will a oversupply of us.

If my H1B transfer is denied, what should I do?

Foreign nationals staying in the U.S. under the H1B status may engage in legal employment until the 6th year expires. They are not restricted to work for only one employer for the entire duration of the H1B. H1B visa holders have the ability to file for a H1B transfer with a new employer if they are offered a better job opportunity. However, there are instances where H1B transfers can be and are denied. This is what you need to do when your H1B transfer is denied.

When filing for H1B visa transfer, you have no obligation to inform your current employer about the transfer petition. When your H1B visa transfer with your new employer is denied, you may still maintain your H1B status with the current company as long your current company is ready to continue your employment.
H1B transfer denial does not interfere with your status. Unless you have violated it or your current H1B employer has terminated your H1B visa, you may return to work for your original employer after receiving the H1B transfer denial notice.
You may opt to appeal your case if you still wish to switch employers and stick with your new employer.
Another option would be leaving the U.S., file for new H1B petition and re-enter the United States with an approved petition. If you do leave the United States you will need a visa stamp to reenter if you do not have a valid visa stamp on your passport. This requires you to appear at the U.S. consulate for an appointment to receive a new visa stamp upon approval.

I think Mr rajesh is too depressed to go through all this process. But your effort is appreciated .

Things happens for reason. Enjoy your time here while your here. Better to be in India with love ones. You will find job back home. Don't get sadden by all this. I think in 2 years everything g will get back to normal
