Hi,

I came to USA on H1B in Jan 2015.Before coming to USA I singed 2 year bond with my employer and if i break it i need pay 20000$.

My employer didn't showed me jobs after coming to USA i searched my job through and friend and job portals.

My employer didn't pay initial 2 month salary.

after one year, I got new opportunity and moved to new Job. now my employer sent Debt Collection notice from Collection Agency through Email.

how to reply to debt collection email?

Get an Attorney, you may sue your employer for unpaid wages and for violating labor laws, good luck!

My transfer petition was recently rejected. In that my emplyer had mentioned a similar clause. USCIS clearly outlined and told him in my reject letter that he cannot hold any such bond against me as all employments in US. Talk to murthy law firm they will tell you. Also project or not when he filed ur petition and if u had it approved he HAS to pay you. Cos he hired you saying he had a project. he cannot withhold your pay

I don't believe email is a legitimate notice. Sounds like a scam.

Its a scam. They wont go through the debt collection. They would go to civil court first.

Simply your employer is trying to fool you. No employer in US can hold employees on a written contracts. Even though you signed those contacts in the beginning before joining - those are of no use.

You have a right to sue your employer and they will take cation against that shady companies as they violated labor laws by NOT paying you for 2 months.

Boss first of all...stop getting worried that some sent you some notice.

Your employer is doing things illegal in US and still he is not at all worried, that's the only difference between You and your employer.

Send him an email: That you will sue him in court by mentioning all details like you have not been paid for 2 months, forcefully ensured to sign illegal contracts etc..

4-5 din tak uski lagi rahegi... ek baar USCIS main case pahuch gaya to road pe aa jayega wo aur aaage ke liye uske saare H1 reject honge....

Isliye bhai Bindaas rehne ka..darne ka nahi...

Lawyer information might be legit. Usually any form of communication by DEBT collection agencies will be sent via regular mail. It might not be valid. Check with any attorney before replying to that email.

I would suggest just choose any of the option with any of the lawyer at http://www.lawbench.com

There fees is very minimal but yes, you will get to know general information from some lawyer.

I have personally used their question section for 20 bucks for my H4 dependent concern and got a response which was sufficient for me to know how to proceed further.

Do not respond to any such emails. by responding,you only prove that you have acknowledged reciept of the email and can serve proof, if there is an action against you.
Anything legal or if you are unsure about consult a lawyer.

In either case, Any legal proceedings are communicated via handed mail NOT emails.( as emails could be lost in Junk folder etc).

You need to be strong and fight the good fight. Dont get scared by these threats from your employer.

Just keep notes from what the contract was with your employer and what they fulfilled and what part of the bargain they did not fulfill. what agreement you signed to and so on, just as your homework.

My employer asked my latest home address but i didnt gave my address.

In the Debt collection email they mentioned that if i don't pay or object in 30 days than it will goes default debt collection so it will screw up my credit history.

I dont know whether this email to scare me or something.
I dont know whether he will really goes to debt collection if i don't respond.

I am thinking about below options
1) consultant lawyer
2) just oppose the notice with 2 month salary point.

if he comes back with a answer than i will go lawyer or make deal with him.

3) just make deal with him.

Send a lawyer notice thats bond is illegal and will sue him for harassment.And tell him that you will complain to USCIS and have his company under investigation.

Don't make deal with him unless you plan to support him in his illegal activities. It will cause problems for ur future visas.

Threaten him saying you ll consult attorney and ur attorney will contact him for further discussion. That should shut him off

I am planning send email saying that if he contact me once again i will send lawyer notice and will inform DOL and USCIS about all his illegal activity. I already prepared small file.

If he came back with answer i will contact lawyer will send notice.
