I do not have any legal advice for you. But as far as I know, you are on H4 visa with EAD. After divorce your dependent status will be gone and hence you will have to go back to your own country. Even if you get to work here, it will be only for few months, as after divorce your legal status in this country will not be maintained. For a child, both parents are equally important. I will request you to reconsider your decision and think wisely. You can give your marriage a second chance.
